Can the Terms of Business be changed to meet my customer’s requirements? Yes, for a small fee Intellect Enterprises will make changes to the standard Terms of Business.
Where is the source code stored? The source code is stored in a secure media storage facility, away from Intellect Enterprises' offices. To ensure preservation of the media, the vaults are equipped with advanced air conditioning units, controlling temperature and humidity. In addition, the latest technology in fire suppression provides an automatic discharge of gas in the event of a fire condition existing. The premises are also protected by permanently monitored intruder alarm systems.
What triggers a release event of the source code?

What can a user do with the source code once it has been released? The user is entitled to use the source code only to maintain their software application. They may not copy it, remove copyright notices, sub-license it to other people, use it to create a product or offer a service to another company.
Can the escrow contract be transferred? Yes, with the consent of the other parties. Please consult the Terms of Business (pdf 33KB) and contact Intellect Enterprises' Escrow team if you are planning to sell your business.
Does Intellect Enterprises carry out tests to determine whether the source code is useable? Under the standard Terms of Business we do not carry out testing. Intellect Enterprises does offer a validation testing service. Intellect Enterprises will quote on an individual basis, if the owner and user require this service. Is Intellect Enterprises software escrow available to non-Intellect members? Yes. Our service is available to all companies, not just Intellect members.
